Regulation on Misfueling Controls for E15 Blends Expected Soon

The Environmental Protection Agency is finalizing a regulation that will outline a new label at gas pumps where E15 is sold in attempt to prevent misfueling by cars and small engines that are incompatible with ethanol blends higher than 10 percent. NMMA has long contended that the rule, which has been in the works since last year, is not enough to address public confusion and protect consumers from engine performance failures, emissions control failures and safety issues that could result from misfueling. The risk of misfueling is especially high for boaters since 95 percent of recreational boats are less than 26 feet in length, making them towable and fuelable at regular automotive gas stations. Just this afternoon, the Senate voted 73-27 to end the $6 billion tax credit for ethanol producers. Although the White House is opposed to a full repeal of ethanol subsidies and there are no plans for the bill to be voted on in the House, the bipartisan vote is seen as a symbol of the growing opposition against subsidies for corn-based ethanol.

NMMA is also continuing the legal challenge that began last December as part of the Engine Products Group against EPA's decision to partially approve E15 for a subset of on-highway motor vehicles. For more information, contact Cindy Squires at 202-737-9766 or csquires@nmma.org.
